As of 2010, there were approximately 23 million licensed drivers in California sharing the roads. The California Department of Motor Vehicles has responsibility for administering the California Motor Vehicle Code which governs the issuance of a driver's license to Californians.
Adult Rules
California Vehicle Code Article 3 sections12800-12819 governs applications for a driver's license. In addition to meeting vision and driving skill requirements, applicants at least age 18 must be citizens or legal residents of the U.S. and have a valid social security number. The name on the application must agree exactly with the Social Security Administration's records.
Under Age 18
Drivers at least age 16 who successfully pass the driving test receive a driving permit. However, they cannot transport passengers under the age of 20 or drive between midnight and 5:00 a.m. unless accompanied by an adult at least age 25 who holds a valid California driver's license.
Military Personnel Rules
Members of the military whose licenses expired while they were serving outside California have a special exemption under Section 12817 of the California Vehicle Code. The DMV issues form DL-236 to extend the expiration date and the form should be kept with the expired license.
Visiting Drivers
Visitors from other states who are at least age 16 can drive in California using the valid, unexpired driver's license or permit from their home state. However, visiting minors under age 18 can drive only 10 days without obtaining a nonresident minor's certificate from the DMV.
