Custom cars in Virginia must meet the same exhaust system requirements as factory cars.
Like most states, Virginia has adopted laws governing the equipment standards for cars. This includes exhaust systems, including mufflers. The law does not distinguish between factory-built automobiles or custom-made automobiles. The same limitations are in place for both types of vehicles. The laws were enacted to protect the public from excessive pollution and noise disturbances. Failure to comply with the vehicle exhaust laws can result in fines or suspension of automobile registration.
Good Working Order
Virginia Code, Title 46.2, Section 1049 was first adopted in 1950 and was last amended in 2006. It prohibits driving or owning a motor vehicle without an exhaust system in good working order. The exhaust system must be factory-installed or comparable to the type of system that would have been factory-installed. The equipment cannot emit more noise than would be emitted by the factory equipment. However, it can reduce noise greater than the level reduced by the factory exhaust system.
Muffler Cutouts
Pursuant to Virginia Code, Title 46.2, Section 1047, the practice of gutting a muffler or removing the baffle plates that dampen noise is illegal in Virginia. Virginians may not sell, offer for sale or operate a motor vehicle with a muffler cutout. The statute does not distinguish between custom made vehicles and factory vehicles.
Stiff penalties
Virginia Code, Title 46.2, Section 1000 provides stringent penalties for failure to comply with vehicle equipment laws, including those concerning exhaust systems. Under this statute, when a defect in vehicle equipment is found by a police officer, he may revoke the registration for the vehicle on the spot and keep it for up to 15 days. During that time, the owner of the vehicle must correct the equipment violation. The vehicle must be inspected at an authorized vehicle inspection site and proof must be provided to the law enforcement agency that took the registration. Failure to make the correction will cause a suspension of the registration for the motor vehicle.
Limitations on Hobby Cars
Virginia limits the use of specially constructed and antique vehicles or hobby vehicles. The registration requirements are generally the same, although certificate of title may be necessary. They may not be used for general transportation. They may only be driven for parades, exhibits or club functions, to test drive or for pleasure within 250 miles of home. Like all vehicles, custom cars must pass a safety inspection, including the exhaust system.
